These Terms and Conditions govern your use of phinisitripindonesia.com (the “Site”). By using the Site you accept these terms. If you do not accept them, please do not use the Site.
1. About this Site and who operates it
The Site is owned and operated by PT Pesona Muda Nusantara, registered office at 18 Office Park Building, 21st Floor, Unit C, Jl. TB Simatupang Kav. 18, Pasar Minggu, South Jakarta 12520, Indonesia.
The same company operates phinisitrip.com. The two sites serve different purposes:
- phinisitripindonesia.com — a destination and route guide. It publishes itineraries, vessel tiers, seasonal conditions, permit information and indicative pricing. It does not take bookings and does not process payments.
- phinisitrip.com — where enquiries are answered, quotations are issued, contracts are formed and payments are made.
We state this plainly so that there is no confusion about who you are dealing with at any point.
2. Nature of our service
We are a travel agent and charter broker. We do not own the vessels listed on this Site. We arrange charters and cabin bookings aboard phinisi vessels operated by independent Indonesian operators, and we arrange associated services such as national park permits, transfers and dive packages.
The operator of your vessel is the party responsible for the physical conduct of the voyage, crewing, seaworthiness and onboard safety. We select operators that hold a valid sailing permit (surat izin berlayar), carry certified safety equipment and employ licensed captains, and we remove operators that fall below that standard.
3. Information on this Site
We take care to keep routes, seasons, fees and vessel descriptions accurate and current. However:
- Prices shown are indicative and vary by vessel, season, group size and date. A binding price is given only in a written quotation from phinisitrip.com.
- Availability shown is indicative. Availability is confirmed only when we confirm it in writing.
- Government fees, permit rules and park regulations change. We publish the figures we believe to be current, but you should verify official fees with the relevant authority before travelling.
- Photographs are representative of the destination and the class of vessel. They are not necessarily of the specific vessel you will board.
4. Permits and government fees
Certain destinations require permits and levies paid to Indonesian government bodies — for example Komodo National Park entrance fees and, in Raja Ampat, the Marine Park Entry Permit and Visitor Entry Ticket.
These are government fees, not our fees. You may always pay them directly to the issuing authority yourself. Where you ask us to arrange them on your behalf, we pass the fee through and will show you the official receipt. We will never ask you to send permit payments to a personal account.
5. Enquiries and how a booking is formed
- You send an enquiry via the form on this Site or via WhatsApp.
- Our team at phinisitrip.com replies with vessel options, a route and a written quotation.
- You confirm in writing which option you want.
- We issue an invoice in the company name. A booking exists only once we have issued that invoice and received the agreed deposit.
No contract is formed by browsing this Site, by submitting the enquiry form, or by messaging us on WhatsApp.
6. Payment safety
Please read this section carefully.
- All invoices are issued in the name of PT Pesona Muda Nusantara and payment is made to a company bank account in that name.
- We will never ask you to transfer money to a personal bank account, an e-wallet, cryptocurrency, or an account in an individual’s name.
- Our bank details do not change mid-booking. If you receive a message claiming our account has changed, stop and call us on +62 811 9600 3034 to verify before sending anything.
- Our only official domains are phinisitrip.com and phinisitripindonesia.com. Our only official email domain is @phinisitrip.com.
If anything about a payment request seems inconsistent with the above, contact us directly before acting on it.
7. Prices, deposits and payment terms
Payment terms, deposit amounts and balance due dates are set out in your quotation and invoice, and those documents prevail over anything on this Site. Prices are quoted in IDR or USD as stated. Bank transfer charges are borne by the sender unless agreed otherwise.
8. Cancellation and changes
Cancellation terms vary by vessel and season and are stated in your quotation before you pay anything. In general, deposits secure a specific vessel on specific dates and are non-refundable once the operator has released those dates to us.
Changes by us or the operator. Weather, sea state, mechanical issues and government instructions can require a change of route, anchorage or vessel. Captains have final authority over routing and may alter or shorten an itinerary for safety reasons. Where a substitution is needed we will offer a vessel of equivalent or higher standard. Where a voyage is cancelled by us before departure and no acceptable alternative is available, we refund amounts paid to us for the unperformed services.
We do not refund on account of weather where the voyage still operates, nor for missed sightings of wildlife, which is never guaranteed.
9. Your responsibilities
- Ensure your passport, visa and any required permits are valid.
- Tell us accurately about medical conditions, dietary needs, swimming ability and diving certification. Some routes are unsuitable for certain conditions.
- Arrange travel insurance covering medical evacuation. Our routes are remote; the nearest hyperbaric chamber or hospital may be many hours away. We strongly recommend diving-specific cover for dive trips.
- Arrive at the stated embarkation point at the stated time. We are not responsible for missed departures caused by delayed or cancelled flights.
- Follow crew instructions and park regulations while on board and ashore.
10. Liability
Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be excluded under Indonesian law, including Law No. 8 of 1999 on Consumer Protection.
Subject to that, our liability is limited to the amounts you have paid to us for the services concerned. We are not liable for the acts or omissions of independent vessel operators beyond our duty to select them with reasonable care, nor for loss caused by events outside our reasonable control, including weather, natural disaster, government action, port closure or civil disruption.
11. Complaints
If something goes wrong during your voyage, please raise it with the guide or captain immediately so it can be addressed on the spot. If it cannot be resolved, email [email protected] within 28 days of the end of your trip with the details.
12. Intellectual property
Text, photographs, route descriptions and layout on this Site belong to PT Pesona Muda Nusantara or are used with permission. You may not reproduce substantial parts of the Site for commercial purposes without written consent.
13. Personal data
Our handling of personal data is described in our Privacy Policy.
14. Governing law
These terms are governed by the laws of the Republic of Indonesia. Disputes are subject to the jurisdiction of the courts of South Jakarta, without prejudice to any consumer rights you have under mandatory law.
